Debt Purchasers & NPL Investors

Acquired claims.A sound basis for recovery.

Legal work on purchased debt starts by connecting the original claim, the chain of transfers and the current balance. We review the available records and identify the questions that need to be resolved before further recovery action.

Preparing the legal review

The claim and its history.

We agree the scope and an appropriate transfer method with you. A general overview is enough for the first conversation.

Records for the agreed review

  1. Underlying claim records

Agreement, account information and documents showing how the claim arose and developed.

  2. Transfer and identification records

Relevant assignment documents and a clear link to the individual claim.

  3. Current case position

Payments, arrangements, objections, existing titles and previous enforcement activity.

Typical starting points

Face value alone
does not establish the legal position.

  1. The transfer records have gaps

Data identifies a new owner, but assignment documents or the link to an individual claim are incomplete.

  2. Different records show different positions

Acquisition data, subsequent payments and earlier arrangements do not readily reconcile. The amount pursued needs a substantiated calculation.

  3. The portfolio contains distinct legal positions

Existing titles, claims without a title, disputed debts and differing evidence require legal consideration suited to each position.

Working together & reporting

Supported facts.
Open questions. Next steps.

The engagement first defines the positions and documents to be reviewed. Findings distinguish supported information from missing evidence and unresolved legal questions. Further investigation and action can then be considered. Agreed reporting can address documentation gaps, procedural progress, decisions required and the basis for prioritising work.

Before instructing the Desk

Two questions to begin with.

Does this replace a commercial portfolio valuation?

No. A legal review addresses the agreed legal and documentation questions. It is not a purchase-price valuation or a forecast of collections, and it does not guarantee a recovery rate.

Can an existing enforceable title be used immediately?

This depends on matters including the title, succession to the claim and procedural history. The applicable requirements and supporting documents need to be reviewed in the individual case.

The next step

Discuss an acquired portfolio or claim.

Outline the records and your central question.
